Terms & Conditions of Sale of
1. Definitions
1.1 “Buyer” means the individual or organisation who buys or agrees to buy Goods from the Seller;
1.2 “Consumer” shall have the meaning ascribed in section 12 of the Unfair Contract Terms Act 1977;
1.3 “Contract” means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
1.4 “Goods” means the articles that the Buyer agrees to buy from the Seller;
1.5 “Seller” means MJL Tackle, Unit 108 Access Self Storage, Third Avenue, Southampton. Hants. SO15 0LD, United Kingdom that owns and operates mjltackle.co.uk;
1.6 “Point of Sale” means the date the item was paid for
1.6 “Supplier” means a member of the public selling an item of fishing tackle to MJL Tackle
1.7 “Website” means mjltackle.co.uk
1.8 “Email” means sales@mjltackle.co.uk
2. Conditions
2.1 Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.
2.2 These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.3 This contract is between the Seller and Buyer. No other person shall have any rights to enforce any of its terms.
2.4 Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of the Terms and Conditions.
2.5 Any variation to these Terms and Conditions (including any special terms and conditions agreed between parties) shall be inapplicable unless agreed in writing by the Seller.
2.6 Any complaints should be addressed to the Seller’s address stated in clause 1.5.
3. Ordering
3.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
3.2 Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 28 days.
4. Price And Payment
4.1 The price of the Goods shall be stipulated on the Website. The price, where applicable, is inclusive of VAT. The price excludes delivery charges.
4.2 The total purchase price, including any VAT and delivery charges, if any, will be displayed in the Buyers Shopping cart prior to confirming the order.
4.3 After the order is received the Seller shall confirm by email the details, description and price of the Goods
4.4 Payment of the price, plus VAT and delivery charges must be made in full before despatch of the Goods.
5. Rights of the Seller (MJL Tackle)
5.1 The Seller reserves the right to periodically update pries on the website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure pries are correct at the point at which the Buyer places an order.
5.2 The Seller reserves the right to withdraw any Goods from the Website at any time.
5.3 The Seller shall not be liable to anytime for withdrawing any goods from the Website or for refusing to process an order.
6. Age of Consent
6.1 Where Goods may only be purchased by persons of a certain age the Buyer will be asked when placing an order to declare they are of the appropriate legal age to purchase the Goods.
6.2 If the Seller discovers that the Buyer is nor legally entitled to order certain Goods, the Seller shall be entitled to cancel the order immediately, without notice
7. Delivery
7.1 Goods supplied within the UK will normally be delivered within 7 working days of acceptance of order.
7.2 We do not currently supply goods to outside of the UK.
7.3 Where a specific delivery date has been agreed, and where this delivery date cannot be met, the Buyer will be notified and given the opportunity to agree a new delivery date to receive a full refund.
7.4 The Seller shall use its reasonable endeavours to meet any agreed date for delivery. In any event time of delivery shall not be of the essence and the Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
7.5 Delivery of the Goods shall be made to the Buyers address specified in the order and the Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.
7.6 Risk in the Goods shall pass to the Buyer upon delivery of the Goods, or where the Buyer fails to take delivery at the agreed time, at the time delivery was attempted.
7.7 Title in the Good shall not pass to the Buyer until payment of the price has been made in full.
8. Cancellation & Return
8.1 The Buyer may cancel the order for any reason up to the point of despatch and any payments made by the Buyer shall be refunded in full within 28 days.
8.2 The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller by phone or email within 14 days if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods and therefore acknowledges that the product received is of satisfactory quality, fit for purpose and as described.
8.3 Where a claim of defect or damage is made, the Goods shall be returned by the Buyer to the Seller within 14 days of delivery. The Buyer shall be entitled to a full refund (including delivery costs). The Buyer will be responsible for returning the item in the original condition & covering any subsequent postal charges.
8.4 If you are a consumer you have the right, in addition to your other rights, to cancel the Contract and receive a refund by informing the Seller by phone or email within 14 working days of the purchase date of the item.
8.5 The Seller will not provide a refund on frozen baits, or any opened Shelf Life baits, pellets or dips & end tackle unless the items have been specified as faulty.
8.6 Goods must be returned by the Buyer at the Buyers expense within 14 days of cancellation in the original packaging and should be adequately insured during the return journey. The Buyer will receive a refund of all monies paid for the Goods (including delivery charges, if any) except for return postal charges. If the Buyer fails to return the Goods following Cancellation, the Seller shall be entitled to deduct the cost of recovering the Goods from the Buyer.
8.7 If the Buyer wishes to return an item they must notify the Seller in writing via email or post
8.8 Goods to be returned must clearly show the order number obtained from the Seller on the package
8.9 Where returned Goods are found to be damaged due to the Buyers fault the Buyer will be liable for the cost of remedying such damage.
8.10 Second Hand items have a one month guarantee, from the point of sale date, regardless of whether the item has been used or not.
8.11 If a Second Hand item is outside of the 14 day money back guarantee period & is within the one month guarantee period, a suitable alternative will be presented by the Seller. The Buyer may be required to send the item back to the Seller before a decision can be made. Under these circumstances the Buyer will be required to cover any postage costs as a result of any repair or replacement part/s. Inline with the Terms above (8.8 & 8.9) the Seller’s decision on a suitable alternative is final.
8.12 Where the Buyer has purchased Gold Cover at the Point of Sale, the guarantee period will be extended to three months.
8.13 The Seller will contribute up to £5.99 on the cost of return postage for a Gold Cover item. The Seller’s £5.99 postage contribution will be sent to the Buyer once the item has been repaired or an alternative sourced.
8.14 The Buyer is permitted to make only one claim on second hand items during the guarantee period.
8.15 Where specified as ‘New’ on the website, Items come with a full Manufacturers guarantee.
9. Selling Or Part Exchanging An Item to MJL Tackle – Terms of the Supplier
9.1 MJL Tackle has a legal obligation to avoid inadvertently buying stolen or fraudulently obtained goods from Suppliers.
9.2 To help us avoid this we employ a strict implementation:
9.3 To obtain a quote a Supplier must complete & submit the appropriate online MJL Tackle Sell My Tackle form, found on the website – https://mjltackle-co-uk.stackstaging.com/sell-fishing-tackle/
9.4 MJL Tackle will value an item based on the details provided from the online form. MJL Tackle reserves the right to adjust this value once a detailed inspection of the item has been carried out.
9.5 In the event that MJL Tackle is not able to provide a competitive quote on an item/s, MJL Tackle reserves the right, unless the Supplier specifies us not to in the ‘comments box’ at the bottom of the form, to forward on the Supplier’s details to another Tackle business, to contact the Supplier to buy the item/s.
9.6 The Supplier will be responsible for posting their item to the MJL Tackle address listed on the website.
9.7 Where the item received is of satisfactory quality, fit for purpose and as described, MJL Tackle will contact the Supplier within 3 working days to arrange payment.
9.8 MJL Tackle will pay the Supplier via bank transfer or PayPal within 14 working days of receiving the item.
9.9 Where a fault or damages, not specified in the original online form are identified by MJL Tackle, a new quote/value will be offered to the Supplier. If the Supplier choses to decline the new valuation the Supplier will be required to pay the return carriage costs as specified on the MJL Tackle website.
9.10 Items returned to the Seller will be posted on a fully tracked signed for service. Confirmation of delivery by the courier will be proof of a successfully returned item.
10. Indemnity
10.1 You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, related entities, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of the Terms or your violation of any law or the rights of a third-party.
11. Limitation Of Liability
11.1 To the maximum extent permitted by law, we (including our parent, subsidiaries, related entities, affiliates, officers, directors, agents and employees) will not be liable for any economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special, indirect or consequential damages (however arising, including negligence) arising out of or in connection with these Terms or your use of our services or products sold.
12. Waiver
12.1 No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its right to do so in the future.
13. Force Majeure
13.1 The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.
14. Severance
14.1 If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
15. Changes to Terms and Conditions
15.1 The Sleer shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
17. Web Site Content Policy
17.1 The website (www.mjltackle.co.uk) is made available to you by MJL Tackle. The use of this website is subject to the following terms and conditions as well as laws applicable in your country. MJL Tackle Ltd reserves the right to revise its terms and conditions from time to time. The use of this website is conditional on your acceptance of these terms and conditions.
17.2 Materials contained on this website are the copyright of the MJL Tackle & it’s Partners. They may not be copied, reproduced, published, downloaded, modified, reused, re-posted or otherwise used in any form without the express written permission of MJL Tackle.
17.3 The only exception to item 17.2 above, is that information provided in pdf format may be printed by you for your personal reference for non commercial use only. The order form provided in pdf format may be printed to enable you to order from us by mail.
